Terms of Service

1. Agreement to Terms

By accessing or using ExaminerIQ at examineriq.sg (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

ExaminerIQ is operated by ExaminerIQ ("we", "us", "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

ExaminerIQ is an AI-powered essay assessment platform that provides feedback on A-Level essays aligned to UK exam board mark schemes (Cambridge CIE, Edexcel, AQA, and OCR). The Service uses a multi-agent AI architecture to analyse essays across Assessment Objectives (AO1–AO4) and generate detailed feedback reports.

Important: ExaminerIQ is a formative assessment tool designed to support learning. It does not replace official examination, teacher assessment, or professional academic advice. Feedback is AI-generated and may not always be accurate. Grades and scores are indicative estimates, not official marks.

3. Eligibility

• You must be at least 13 years old to use the Service.
• If you are between 13 and 16, you must have parental or guardian consent to use the Service.
• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.

4. Plans, Pricing, and Payments

4.1 Free Plan (Explorer)

• 3 essay submissions per month.
• Access to all supported exam boards.
• AO-by-AO scoring and basic improvement tips.
• No credit card required.

4.2 Paid Plan (Scholar)

• $5.00 USD per month, billed monthly.
• Unlimited essay submissions.
• Detailed examiner reports, improvement tracking, priority processing, and personalised action plans.

4.3 Daily Submission Limit

All users are subject to a daily limit of 10 essay submissions per day. This limit resets at 3:00 PM SGT (Singapore Time) daily. This limit is enforced to ensure service quality and may be adjusted at our discretion.

4.4 Billing and Cancellation

• Scholar subscriptions are billed monthly in advance. You may cancel at any time.
• Upon cancellation, you retain access to Scholar features until the end of your current billing period.
• We do not offer refunds for partial billing periods, except where required by applicable law.
• We reserve the right to change pricing with 30 days' notice. Price changes do not apply to the current billing period.

5. Token Rewards System

• Tokens are earned through activities including profile completion, regular essay submissions, referrals, and hitting improvement milestones.
• Tokens can be redeemed for bonus essay submissions, premium features, and priority processing.
• Tokens have no monetary value and cannot be exchanged for cash, transferred to other users, or refunded.
• We reserve the right to modify the token system, including earning rates and redemption options, at any time with reasonable notice.
• Abuse of the token system (e.g. creating multiple accounts for referral bonuses) may result in token forfeiture and account suspension.

6. Acceptable Use

You agree not to:

• Submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Submit essays that you do not have the right to submit (e.g. copyrighted works by others without permission).
• Use the Service to generate content for the purpose of academic dishonesty or plagiarism. ExaminerIQ is a feedback and learning tool — not an essay writing service.
• Attempt to reverse-engineer, decompile, or extract the AI models, prompts, or algorithms underlying the Service.
• Use automated scripts, bots, or scrapers to access the Service.
• Circumvent usage limits, rate limiting, or access controls.
• Create multiple accounts to abuse the free tier or token system.
• Resell, redistribute, or commercially exploit the Service or its outputs without our written permission.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

7.1 Your Content

You retain ownership of the essays you submit. By submitting an essay, you grant us a limited, non-exclusive licence to process it through our AI system for the purpose of generating your feedback report. We do not claim ownership of your essays.

7.2 Our Content

The Service, including its design, code, AI models, feedback templates, branding, and documentation, is owned by ExaminerIQ and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our written permission.

7.3 Feedback Reports

AI-generated feedback reports are provided for your personal educational use. You may share your own reports (e.g. with teachers or tutors) but may not commercially redistribute them.

8. Disclaimers and Limitations

8.1 AI-Generated Content

• Feedback is generated by AI and may contain inaccuracies, errors, or inconsistencies.
• Scores and band grades are indicative estimates and do not guarantee any particular result in official examinations.
• The Service should be used as a supplementary learning tool alongside teacher feedback and official exam preparation.

8.2 Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8.3 Limitation of Liability

To the maximum extent permitted by law, ExaminerIQ and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Service, regardless of the theory of liability.

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

9. Account Termination

• You may delete your account at any time through your account settings.
• We may suspend or terminate your account if you violate these Terms, abuse the Service, or engage in fraudulent activity.
• Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.
• Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall survive.

10. Indemnification

You agree to indemnify and hold harmless ExaminerIQ and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Singapore. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Singapore.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes affecting your rights, we will also notify you by email if you have an account. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
